NON BREEDING AGREEMENT

YOUR GOLDEN RETRIEVER PUPPY IS BEING SOLD TO YOU ON A NON-BREEDING AGREEMENT AND I WOULD LIKE TO EXPLAIN WHY.

A NON-BREEDING AGREEMENT IS AN IMPORTANT, STRICT CODE OF ETHICS THAT ALL REPUTABLE BREEDERS FOLLOW. WHEN A PERSON DECIDES TO BREED A LITTER OF PUPPIES, IT IS SHOULD BE WITH ONE REASON IN MIND. THIS IS TO BREED FOR THE BETTERMENT OF THE BREED. THIS MEANS THAT OF THE UTMOST IMPORTANCE IS THE QUALITY OF THE MATES AND WHAT THE OUTCOME OF THAT UNION IS LIKELY TO PRODUCE. THERE IS A LOT OF PLANNING, RESEARCH, TIME, MONEY AND OF COURSE LOVE AND CARE THAT GO INTO NUTURING A LITTER OF ADORABLE PUPPIES TO THE POINT WHERE THEY ARE READY TO GO TO THEIR NEW HOMES. A NON-BREEDING AGREEMENT HELPS BREEDERS TO BE ABLE TO PROTECT THE GOLDEN RETRIEVER BREED AND IT'S FUTURE.

IT IS THROUGH MY LOVE FOR THIS WONDERFUL BREED THAT MY GOAL IS TO PRESERVE AND PROTECT THE QUALITIES THAT FIRST ATTRACTED US TO IT.

The breeder and the purchaser agree that this Golden Retriever is being sold, on both a CKC non breeding agreement and a personal non breeding contract, to fulfill the role of a cherished family companion and as such will not be used for breeding purposes.

This Golden Retriever has been examined by a veterinarian, given its first set of vaccinations and has been wormed. To the knowledge and belief of this breeder, it is in healthy condition and ready to go to its new home.
If, however, after examination by a veterinarian of the purchaser's choice, this Golden Retriever is determined to be in unhealthy condition, it can be returned to the breeder for a full purchase price refund. Any such claim must be made within 7 days of the date of sale and be substantiated by a written report, signed by the examining veterinarian.

All veterinary expenses, after the Golden Retriever's departure from the breeder, are the responsibility of the purchaser.

The sale of this Golden Retriever puppy is subject to rights and obligations of both the breeder and the purchaser, as our goal is to work together to produce a healthy family companion.
Please read these thoroughly as any refund / replacement will be based on the following responsibilities being met by the purchaser.

PURCHASER:
The purchaser agrees to personally care for the dog in a healthy and safe manner such as but not limited to:
1) provide a safe environment for the dog to be raised and play in.
2) provide quality nutrition which is recommended and supported by the breeder.
3) provide responsible veterinary care including being maintained at a healthy weight and following the 3 year vaccination protocol which is now legally accepted across Canada.
4)) taking it to ongoing obedience classes, which are approved and supported by this breeder, until at least 2 years of age. Goldens do not train themselves be to good canine citizens, this is your job.
5) this dog is to be raised as an indoor family companion, not kept outside for extended periods of time. Golden retrievers are very people oriented (it is just one of the traits that endear them to us) and as such do not thrive living as an "outdoor dog".
6) eye diseases are becoming very prevalent in the golden retriever breed, as such, annual eye exams (preferably by a certified canine ophthalmologist) must be performed and written records maintained. These eye exams should be done annually at the same time as the dog's annual wellness exam.
7) the dog MUST be kept in healthy physical condition as this is VERY important to the overall health of the dog. Avoid either extreme of too little or too much weight, as this places stress on your dog through out its entire life time. First on the puppy's developing bones and joints, then on the mature adult dog's ability to participate in all that life has to offer and finally on the senior dog's aging bones, joints and circulatory system.
8) allowing the breeder access to the dog's veterinary care record

BREEDER:
As the breeder of this Golden Retriever, I have made conscious decisions when planing this breeding to do the best I can to ensure it will live a life unencumbered by hereditary problems such as hip and elbow dysplasia, inherited heart disease and inherited eye disease. I have also done my best to ensure this golden retriever will have the truly loving golden temperament that is the hallmark of this breed.
As we are dealing with a living being, unknown genetic and environmental influences, I obviously cannot guarantee that none of these issues will not arise. What I can guarantee you is that I will be there for your companion and you and let you know what I am prepared to do should any of the following be diagnosed with in the first 3 years of the dog's life:
1) hip & elbow dysplasia: as both positioning of the dog during the x-ray procedure and knowledgeable assessment of the resulting x-rays are critical pieces when it comes to ascertaining if dysplasia is present, the x-rays must be performed by a vet I have faith in and must be submitted to OFA for evaluation.
As grade1 hip or elbow dysplasia will not have a noticeable adverse effect on the dog in its role as your companion, an OFA rating of grade 2 or higher must be assigned.
2) inherited heart disease: the dog must be examined by a Board Certified Cardiologist who finds there is significant heart disease present. These specialists are rare in Ontario but I will assist you in finding a reputable one.
3) inherited eye disease: 2 conditions must be met to determine if the dog has an inherited eye disease. The 1st condition I have mentioned previously, the dog must have had annual eye exams and I must be given written proof of these. The 2nd condition is the dog must be examined by a Certified Canine Ophthalmologist who assesses the dog has a significant eye disease present. Again, I can assist you in finding a reputable one. 

REFUND OPTIONS:
1) If the purchaser decides to return the dog a full purchase price refund or a replacement dog shall be given.
2) If the purchaser decides to keep the dog a partial refund shall be given.
As I only have litters infrequently, I will be given 1 year to provide either of the above options.

Assisting people, who have Golden Retrievers of my breeding, work through any problems that may occur, is a responsibility I take on willingly. Should any issue arise at any age, whether it is a concern about, health and or possible hereditary problems, temperament problems, general canine and or Golden Retriever breed specific veterinary care, training techniques, I am always available to help in any way I can. Over the years, that I have been breeding Golden Retrievers, I have not only gathered a wealth of personal Golden Retriever breed specific knowledge I have a network of well respected specialists on whom I can call for their assistance.

FIRST RIGHT OF REFUSAL

THE PURCHASER GUARANTEES THE BREEDER FIRST RIGHT OF REFUSAL.
I MUST BE CONTACTED IF THIS DOG IS TO BE SOLD, DISPOSED OF OR EUTHANISED IN ANY WAY.
***Finding good alternative homes for goldens of my breeding, who can no longer live with the people with whom they were originally placed, is a responsibility I take very seriously. Not only because I want to keep track of where the golden retrievers I have bred are living and under what conditions, but also because I usually have people who are interested in an older golden retriever as opposed to a puppy, who I have already screened and found to be suitable for providing caring homes.***

CONDITIONS THAT VOID THIS AGREEMENT

1) This contract is void if any injury, neglect or abuse is obvious.
(including but not limited to unhealthy weight)
2) This contract is void if there has been an unauthorized change of ownership
(as stated in the 1st right of refusal section of this agreement)
3) This contract is void if this golden retriever has been bred.
(as it is being sold on both: a CKC non breeding registration and a personal non breeding agreement between the purchaser and the breeder)
4)  This contract is void if annual eye exams have not been preformed (as stated on pg. 2 of this agreement) and or proof of these annual exams cannot be provided
5)  This contract is void if the breeder is not allowed access to the dog's veterinary care record. (as stated on page 2 of this agreement)

If at anytime I am made aware that any of these conditions are / have been present.
I will immediately take possession of the Golden Retriever, with no financial reimbursement given to the owner and there will be a $5000.00 penalty placed against the purchaser, which I will collect through the court process.
 

Upon reading and understanding this health guarantee and contract of sale, we find the terms and conditions to be mutually agreeable and legally binding.

PUPPY RESERVATION AGREEMENT
A RESERVATION FEE HAS BEEN RETAINED BY THE BREEDER FOR A PUPPY FROM LITTER ____________________________________

THIS IS A GOOD FAITH REFUNADABLE FEE.
THIS MEANS THAT AT ANYTIME SHOULD EITHER THE PURCHASER OR THE BREEDER DECIDE TO CANCEL THE RESERVATION, THE DEPOSIT WILL BE RETURNED TO THE PURCHASER.

THE BREEDER HOLDS THE RIGHT TO ALL FINAL DECISIONS REGARDING THE MATCHING OF PUPPIES WITH THEIR NEW OWNERS.

COMPANION PUPPIES ARE MATCHED WITH THEIR NEW OWNERS BASED ON TEMPERAMENT AND SUITABILITY.
OF COURSE YOUR INPUT, WITH REGARD TO WHAT YOU WOULD LIKE IN A GOLDEN RETRIEVER PUPPY (NOT A SPECIFIC PUPPY IN THE LITTER) IS BOTH APPRECIATED AND EXPECTED.
THIS INPUT CAN BE PROVIDED VIA TELEPHONE, EMAIL AND THROUGH IN PERSON CONVERSATIONS WITH THE BREEDER.

LITTERS ARE EVALUATED FOR TEMPERAMENT TRAITS AND CONFORMATION QUALITIES AROUND 8 WEEKS OF AGE.
BASED ON THE RESULTS OF THESE EVALUATIONS IS WHEN I WILL DECIDE:
1) WHICH PUPPY / PUPPIES I WILL BE KEEPING
2) WHICH PUPPY / PUPPIES WILL BE PLACED WITH OTHER BREEDERS
3) WHICH PUPPIES I WILL BE MATCHING UP WITH WHICH PURCHASERS.

POSSIBLE REASONS THE BREEDER MAY RETURN THE RESERVATION FEE COULD INCLUDE BUT ARE NOT BELIMITED TO THE FOLLOWING
1) UNABLE TO MEET WITH ALL OF THE FAMILY MEMBERS
2) UNDESIREABLE BEHAVIOUR ON THE PART OF FAMILY MEMBERS
3) DURING THE VET CHECK THE PUPPY IS FOUND TO HAVE AN ISSUE WHICH PRECLUDES IT FROM BEING PLACED AT THAT PRESENT TIME
